Notice to New Mexico Water Service customers

New Mexico Water Service Company (NMWSC) filed an approval for a rate increase of its Sewer Utility Capacity Charge with the New Mexico Public Regulation Commission on April 18, 2025 (PRC Case No. 25-00035-UT). NMWSC’s filing is based on its projected costs for sewer facility upgrades and expansion. PRC proceedings have begun to address the requests in NMWSC’s application.

No action on your part is necessary unless you wish to attend the public hearing or provide comments.

The following table compares present and anticipated bills for customers of Rate No. 5, Sewer Utility Capacity Charge, and is provided for informational purposes and may vary once effective.

Tax Adjustment Clause:

Billing under this schedule could be increased by an amount equal to the taxes payable under the Gross Receipts and Compensation Tax Act and all other taxes, fees or charges (exclusive of ad valorem taxes and state and federal income taxes payable by New Mexico Water Service Co.) and levied or assessed by any governmental authority on the utility service rendered, or on the right or privilege of rendering the service, or on any object or event incidental to the rendition of this service.

Public Hearing

A public hearing will be held at 9:00 a.m. on September 17 and 18, 2025, to hear and receive testimony, exhibits, and legal arguments about NMWSC’s application. The public hearing will take place online via the Zoom platform. The hearing will be streamed live on the Commission’s YouTube channel, which can be accessed at https://www.prc.nm.gov/public-hearings/.

If you wish to participate in the hearing as a party to this case you must file a motion for leave to intervene, pursuant to 1.2.2.23 NMAC on or before July 15, 2025. Anyone filing pleadings, documents or testimony in this case will serve a copy on all parties and the Commission Staff. Filings must also be sent to hearing examiners Christopher P. Ryan and Patrick Schaefer at [email protected] and [email protected]. The Commission’s Rules of Procedure, found at 1.2.2 NMAC, shall apply to this case except as modified by Order of the Commission or Hearing Examiners. Anyone filing pleadings, documents, or testimony in this case shall comply with the Commission’s electronic filing policy. Filings must be in PDF format and be Optical Character Recognition (“OCR”) enabled. If a PDF is not OCR enabled, it will be returned to the sender. Anyone whose testimony is filed in this case must attend the public hearing and submit to examination under oath unless otherwise determined by the hearing examiners.

Public Comment

If you’re interested in giving feedback in the case but do not wish to become a party, you may make written and oral comments as allowed by Rule 1.2.2.23(F) NMAC. Public comments are not taken during the evidentiary hearing because they are not evidence, however they are reviewed and considered by Commission staff.
